Please read these terms carefully before using MedIQGPT.

1. Acceptance of Terms

By creating an account or otherwise accessing or using MedIQGPT(the “Service”), you agree to be bound by these Terms and Conditions (“Terms”) and our Privacy Policy. If you do not agree to these Terms, do not access or use the Service.

These Terms constitute a legally binding agreement between you and DialectAI Technologies Private Limited(“Company”, “we”, “us”, or “our”), the operator of MedIQGPT.

2. Eligibility

You must meet the following requirements to use the Service:

  • Age:You must be at least 13 years old. Users who upload or manage medical records (their own or a dependent’s) must be at least 18 years of age, or a legally authorised guardian of a minor.
  • Legal capacity: You must have the legal capacity to enter into a binding contract in your jurisdiction.
  • Compliance: Your use of the Service must comply with all applicable local, national, and international laws and regulations.

By using the Service, you represent and warrant that you meet all eligibility requirements.

3. User Obligations

When using MedIQGPT, you agree to:

  • Provide accurate information: Ensure that the data you upload, including personal details and medical records, is accurate, complete, and lawfully obtained.
  • Use the Service lawfully: Access and use the Service only for lawful purposes and in accordance with these Terms.
  • Maintain account security: Keep your login credentials confidential and notify us immediately if you suspect unauthorized access to your account.
  • Obtain proper consent: When uploading records for family members or dependents, ensure you have obtained all necessary consent or legal authority to do so.
  • Respect others’ privacy: When using sharing and collaboration features, respect the privacy and consent of the individuals whose records you are sharing.

4. Prohibited Uses

You must not use MedIQGPT to:

  • Upload, store, or transmit content that is unlawful, harmful, or fraudulent.
  • Scrape, harvest, or systematically extract data from the Service without written permission.
  • Reverse engineer, decompile, or disassemble any part of the Service.
  • Attempt to gain unauthorized access to any other user’s data, records, or account.
  • Misuse shared-record features to access medical records of individuals who have not authorised you.
  • Use the Service to diagnose, treat, cure, or prevent any disease or medical condition (see Medical Disclaimer below).
  • Transmit any viruses, malware, or other harmful code.
  • Violate the privacy or intellectual property rights of any third party.

5. Intellectual Property

Your records are yours: You retain full ownership of all medical documents, images, and data you upload to the Service. By uploading content, you grant DialectAI Technologies Private Limited a limited, non-exclusive, royalty-free licence to process, store, and display your content solely for the purpose of providing the Service to you.

Our software and brand: MedIQGPT, its logo, interface design, underlying software, and all intellectual property embodied in the platform are owned by or licenced to DialectAI Technologies Private Limited. You may not copy, modify, distribute, or create derivative works from any part of our software without prior written consent.

6. Medical Disclaimer

MedIQGPT is a health record storage and retrieval tool, not a medical device and not a substitute for professional medical advice, diagnosis, or treatment.

  • Nothing in the Service constitutes medical advice, clinical guidance, or a doctor-patient relationship.
  • AI-generated summaries and responses are informational only and may not be accurate or complete. Always verify with a qualified healthcare professional.
  • For medical emergencies, call your local emergency services immediately. Do not rely on this Service in an emergency.
  • The Company expressly disclaims any liability arising from your reliance on information retrieved through the Service for clinical decision-making.

7. Limitation of Liability

To the maximum extent permitted by applicable law, DialectAI Technologies Private Limited and its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of data or records
  • Service unavailability or interruption
  • Unauthorized access to your account
  • Any reliance on AI-generated health information

Our total cumulative liability to you for any claim arising from use of the Service shall not exceed the amount paid by you to us in the twelve (12) months preceding the claim. If you are on the free tier, our liability is limited to the maximum extent permitted by law.

Some jurisdictions do not allow the exclusion or limitation of certain liabilities; in such jurisstances, our liability is limited to the greatest extent permitted by law.

8. Governing Law

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in India, unless otherwise required by applicable law in your jurisdiction.

Users in the United States acknowledge that the Service is operated from India and that Indian law governs the agreement, without prejudice to any mandatory consumer protections available under applicable local law.

9. Changes to Terms

We may update these Terms from time to time. When we make material changes, we will notify you via email or an in-app notice at least 14 days before the changes take effect. Your continued use of the Service after that date constitutes acceptance of the revised Terms.

If you do not agree to the revised Terms, you may close your account before the changes take effect. See our Refund & Cancellation Policy for details on account closure and data export.
